3.0 LIMITATIONS ON LIABILITY

UNDER NO CIRCUMSTANCES SHALL WE OR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR DISTRIBUTING THE SITE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES FOR LOSS OF PROFITS, GOOD WILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) THAT RESULT FROM (i) THE USE OF OR INABILITY TO USE THE SITE, (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SITE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE. YOU HEREBY ACKNOWLEDGE THAT THIS PARAGRAPH SHALL APPLY TO ALL CONTENT, MERCHANDISE, AND SERVICES AVAILABLE THROUGH THE SITE. BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

4.0 INDEMNIFICATION

You hereby agree to indemnify, defend and hold Fretocizer.com and LittleFretty.com and all officers, directors, owners, agents, information providers, affiliates, licensors and licensees (collectively, the "Indemnified Parties") harmless from and against any and all claim, demand, liability or cost incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of the Terms of Use or otherwise arising from your use of the site, including, without limitation, reasonable attorneys' fees. You shall cooperate as fully as reasonably required in the defense of any claim. Fretocizer.com and LittleFretty.com reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.

5.0 PRIVACY POLICY

Fretocizer.com and LittleFretty.com DOES NOT USE OR SELL ANY INFORMATION RECEIVED, TO ANY THIRD PARTY.  

6.0 RETURN POLICY

     All sales have a 15 day return policy.  If the product is not or is no longer available or it was not delivered as purchased through standard ground or  postal mail or package delivery service, the Buyer may receive a full refund within 30 days of purchase less the shipping and handling charges.   WD will track all shipments to the best of it's ability.  If not fully satisfied, simply return the item to the address below and mark return on the envelop or package with your payment information.  You will not be return credited any monies until Fretocizer.com gets the item back.  We will credit your account less $10.00 including the shipping and handling charges (typically $5.00) and a $5.00 restock charge as appropriate.   Be sure to provide the Buyer name, address and telephone number in case we have problems with your credit or payment  transaction.    All payments are typically due in full before shipment and or delivery of the Product.   If product delivery has been confirmed, the buyer will pay in full Fretocizer.com for the costs due upon receipt.    Larger volume order discounts may include net 30 day payment terms and may take additional lead delivery times.  Payments for Order, product receipt not received within fifteen (15) days from the Order invoice or receipt date or any additional Orders may be cancelled and be subject to an additional surcharge of 2% per month on the balance due.

7.0 NON WARRANTY 

   Fretocizer.com is not responsible for, makes no warranty or representation regarding, and will not be liable for, any damages physical or healthcare costs or loss or improvement in playing ability resulting from the use of the products, services, or content information available through this Website and Fretocizer.com.   If you have any existing or preexisting medical condition of m it is recommended you do not use Little Fretty.  Guitar playing can cause muscle and tendon fatigue during and after playing.   Use of Little Fretty is meant to imitate normal guitar fretting.  The plastic foam material is designed to provide a squeeze pressure resistance which can cause temporary minor discomfort.  If the discomfort persists after use, discontinue use immediately and consult with a licensed physician.  WARNING: DO NOT USE IF DISCOMFORT PERSISTS.   If you decide to purchase or use, or access any such product or information, you do so entirely at your own risk.
